中文摘要:以往对"新业态"之于劳动关系影响的研究,主要集中于分享经济等存在显性影响的领域。本文将研究视角投向从转型产业过渡到新业态的快递行业,分析"互联网+"的引入对加盟制快递企业劳动关系的隐蔽影响。研究发现,快递总部为整合寄递流程对加盟商施加的"统一管理",借助于"互联网+",已对加盟商层面的劳动关系产生"破壁效应",进而对快递员工作时间、工资等核心劳动权利产生了"反射性损害"。为解决当下快递员劳动保护存在的普遍性问题,有必要将快递总部的此种"统一管理"纳入法律管制。在策略选择上,立法层面可以考虑相关部门联合出台规范性文件设定快递行业"统一管理"的规则;劳动执法层面可以通过部门间的管制合作,构建劳动执法大数据,升级劳动执法手段,维护快递员的休息权、劳动报酬权;集体劳动权层面,可以寻求建立行业工会,政府推动集体协商等方式增强快递员集体谈判能力,抑制"统一管理"可能产生的反射性损害。

外文摘要:The study on the influence of new format on labor relations mainly focused on the areas where the influence could be observed obviously, such as in the field of sharing-economy. Differencing from the research which has been made, this paper will focus on the express industry which has experienced transition from the traditional industry to the new format, analysis the influence of this transition on the labor relations of t express franchise business. Through research, such fact was revealed, in order to integrated delivery process, the express delivery headquarters imposed highly unified management on the franchisee ,with the help of Internet and work rules, this unified management finally work on the employees which franchisee haired, furthermore created reflective damage on their core labor rights, such as standard working hours. In order to solve those problems concerning with courier, it is necessary to regulate the unified management of express headquarters. In terms of strategy selection, government departments relating with express industry may jointly issued regulatory document ,setting the rules on unified management of express headquarters; labor law enforcement department could building up enforcement Big Data through interdepartmental cooperation, which could upgrade labor enforcement ability; courier also could depend on themselves, thought seeking to establish trade unions, and getting help from the government, they might have enough power to make collective bargaining with enterprise.
